Securing H-3 Visas

Colorado immigration firm Battan Alpert Hutchings LLP helps U.S. companies bring trainees from around the world to the United States. H-3 trainees receive U.S. training which enables them to successfully complete their work abroad. The following is intended to provide a general overview of the H-3 immigration issues. To discuss your H-3 visa needs, contact our Boulder H-3 immigration lawyers at Battan Alpert Hutchings LLP.

H-3 visas may be used by U.S. companies to train foreign national employees and contractors. H-3 trainees may come to the U.S. for a period of specific training of up to 18 months in length. Following the training, the trainee will return abroad to use the training he or she received in the U.S.

To start the process, we prepare and file a nonimmigrant petition with U.S. Citizenship and Immigration Services. The U.S. company files the petition on behalf of the trainee. The petition must include a complete and detailed training program which includes the kind of training to be given, the proportion of time which will be devoted to productive employment, the number of classroom instruction hours, how the trainee will be supervised, the reason why the training cannot be done oversees and how the training program will benefit the U.S. company. We work with the company to develop a training plan which is suitable to USCIS.
